1. No investment advice

BELEM provides execution and custody services only. Nothing on this website, in our dashboards, in our communications, or in any educational material constitutes investment advice, tax advice, legal advice, or a solicitation to buy or sell any asset. You are solely responsible for evaluating the suitability of any transaction in light of your own circumstances, and should consult an independent licensed adviser where appropriate.

2. Market and financial risk

Digital assets are highly volatile. The value of crypto-assets can fall as well as rise, sometimes sharply and within short periods. You may lose all of the capital you allocate to digital assets. Past performance is never a reliable indicator of future results. Leveraged or derivative positions can result in losses exceeding the amount deposited; BELEM does not currently offer such products to retail clients.

3. Counterparty and technology risk

Although BELEM operates segregated banking, multi-signature custody, and institutional-grade infrastructure, no financial service is risk-free. Network outages, blockchain reorganisations, smart-contract failures, cyber-attacks, or insolvency of upstream banks or liquidity providers may affect the availability of funds. BELEM mitigates these risks but does not guarantee against them.

4. User responsibility

You are responsible for:

  • Maintaining the confidentiality of your credentials and two-factor authentication device.
  • The accuracy of every wallet address, IBAN, or beneficiary detail you submit. Blockchain and SWIFT transactions are irreversible.
  • Declaring and paying any taxes due in your jurisdiction on gains, income, or transfers conducted through BELEM.
  • Complying with the laws applicable to you, including capital controls and licensing requirements.

5. Limitation of liability

To the maximum extent permitted by law, BELEM, its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunities, arising out of or in connection with your use of the platform. BELEM's aggregate liability for any direct damages shall not exceed the fees paid by you to BELEM in the twelve months preceding the event giving rise to the claim.

6. Data use

Information you submit is processed in accordance with our Privacy Policy. By using the platform you acknowledge that BELEM is required to share certain data with regulators, correspondent banks, and Travel-Rule counterparties.

7. No warranty

The website and platform are provided on an "as is" and "as available" basis. BELEM disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

8. Jurisdiction

These disclaimers are governed by the laws of the Province of Ontario, Canada, without regard to its conflict-of-laws principles. Any dispute will be submitted to the exclusive jurisdiction of the courts of Toronto, Ontario, subject to any mandatory consumer protections available to you in your country of residence.
